The recent article by R. P. Saller on Roman dowry in the Principate makes some interesting and important suggestions about the function of dowry and its role in the devolution of property. I am in broad agreement with a good deal of what he says, and would not dispute his views that dowry was, as shown by the requirement of collatio dotis, regarded as in a sense part of a woman's patrimony, and that the rules for the recovery of dowry (...) show that the purpose of giving dowry was not held to rest on one single principle, but included provision both for the expenses of the wife's maintenance during marriage and for a possible remarriage after divorce or widowhood. However, his remarks on both points need some qualification and amplification. Briefly, I hope to show that the oddities and anomalies noticed by Saller in the rules governing the recovery of dowry at the end of a marriage are apparent rather than real, since these rules rest, not on conflicting views about the purpose of dowry, but on the fact that the husband had full legal ownership of the dowry during marriage, together with the right of the wife or her pater to an actio rei uxoriae for recovery of dowry; that the rules for collatio dotis applied only if the woman herself chose to claim a share in her father's estate on intestacy beyond the amount of her dowry; that the use of the dowry for the wife's support was an equitable, rather than a legal, requirement. ABSTRACTAnalytic philosophy is often associated with a physicalistic naturalism that privileges natural-scientific modes of explanation. Nevertheless there has since the 1980s been a heterodox, somewhat subterranean trend within analytic philosophy that seeks to articulate a more expansive, ‘non-reductive‘ conception of nature. This trend can be traced back to P.F. Strawson’s 1985 book Skepticism and Naturalism: Some Varieties. However, Strawson has long been ignored in the literature around ‘soft naturalism’ – especially in comparison to John McDowell. One of the reasons for (...) this is that Strawson’s account of soft naturalism is not often viewed as particularly plausible – it has come in for heavy criticism from the likes of Sebastian Gardner and Robert Stern. In this paper, I argue that Strawson’s soft naturalism ought to be re-assessed: that his critics can be refuted, and that his naturalism remains a compelling alternative to the likes of McDowell’s. I attempt this through a ‘radicalisation’ of the modest Strawson’s position, demonstrating that his naturalism has implicit in it something like Marx’s conception of human ‘species-being’. (shrink)

The accurate pricing of securities in the capital markets depends upon the markets being both efficient and fair. In management buyout transactions (MBOs), the price bid by inside managers enhances the efficient pricing of securities but raises a reasonable doubt about the fairness to existing shareholders. This study addresses this fairness question in MBOs and offers short-term and long-term legal alternatives which allow both the efficiency and fairness criteria to be met. In the short-term the case law established in the (...) Basic v. Levinson decision for merger negotiation disclosures should be applied to MBO transactions. Over the longer horizon, legislative changes should be made to existing securities laws. Applying the investor protection principles of the 1933 and 1934 securities acts to MBO transactions will suppress the temptation of managers to extract shareholder wealth for their personal gain. Abstract: This paper conceptualizes the interaction of three discursive paths: the history of science, scientific education, and the debate about the Filipinization of scientific education. The paper analyzes the form of scientific revolution in the field of medicine which is different from its counterparts in the fields of astronomy and physics; as such, the paper contributes a particular narrative of that provides proof that it is possible to tackle scientific issues using the Filipino language as medium. It assumes that the (...) Filipino language should be used in the teaching of science and in scientific research. The scientific revolution in medicine is seen as the eventual downfall of Hippocrates and Galen and the rise of the theories of Paracelsus, Vesalius, Fracastoro , and Harvey. (shrink)

Discussion of the problems arising in conjunction with the rapid progress of cybernetics demands a philosophical analysis of the basic concepts in the field. This problem cannot yet be considered to have been resolved. As has been emphasized, among others by Academician A. I. Berg , even one of the basic concepts of cybernetics — the concept of information — does not yet have a satisfactory definition. This situation is primarily due to the fact that study of information problems is, (...) in general, of recent origin. In our reflections upon the view of Leibniz on the many religions and their relations we elaborate three points. In the first place, Leibniz appears to be a faithful Christian, nominally a Lutheran, but not exactly bound to just one confession. He tried to be a real ecumenist. During all his career he made efforts to come to one, universal church , on a dogmatic as well as a practical level. For this aim he corresponded on these topics with many (...) influential catholics of his time, e.g. with Arnauld, Bossuet and Pellisson . Leibniz saw the other forms of monotheism as preliminary stages of Christianity. For him the remaining religions were paganism and therefore they should be suppressed. But Christianity would be enriched by an exchange with the three other forms of monotheism. In the second place, we may conclude that Leibniz understood toleration as a recognition of the other and as an expectation for exchange. But in the third place, we have to take into account his final religious perspective: natural religion . This is an almost philosophical religion with Christian features, usually called deism. With the help of his natural religion Leibniz wanted to combat what he called the atheism and materialism of the philosophy of his time, i.e. the ideas of Hobbes, Descartes and Spinoza. But his own position is rather close to them. (shrink)

MY programme is as follows: I shall draw a general distinction between morals and moral philosophy in order to show that an ethical theory cannot be neutral and autonomous but must have an empirical foundation. Both ethical naturalists and existentialists agree that an adequate moral theory must be based on anthropological considerations. They however differ on one major issue: ethical naturalists maintain that such a theory must be scientifically grounded, existentialists that it must be grounded on experience phenomenologically described. The (...) weakness of the naturalists’ position becomes apparent when some anthropological notion like the concept of action is clarified, since human behaviour of a morally relevant kind cannot be fully understood from a scientific point of view.
